Divorce Lawyers in Delhi NCR: जब Matrimonial Dispute आपकी Family Property तक पहुँच जाए
“Sir, शादी का dispute तो husband-wife के बीच था… फिर मेरे बूढ़े parents की property क्यों फँस रही है?”
यह सवाल कई families में बहुत देर से उठता है — जब मामला already court तक पहुँच चुका होता है.
12 May 2026 को Delhi High Court के एक महत्वपूर्ण मामले में elderly parents ने उस arrangement को challenge किया जिसमें उनकी property से daughter-in-law और grandchildren को हटाने के साथ permanent alternate accommodation का burden भी उनके ऊपर डाला गया था.
Court ने एक important distinction किया.
DV Act या Senior Citizens Act में daughter-in-law को “permanent accommodation” देने का कोई statutory provision नहीं है. कानून shared household से जुड़े rights को recognise करता है, लेकिन उसे automatically lifetime/permanent alternate accommodation में convert नहीं किया जा सकता.
इस particular case में Court ने arrangement modify करते हुए monthly payment का mechanism रखा और advance payment के बाद property vacate करने का direction दिया. साथ ही property और अन्य assets से जुड़े rights को अलग रखा गया.
लेकिन husband के लिए असली lesson क्या है?
अगर आप Delhi NCR में financially established husband हैं, business owner हैं, या आपकी अपनी family property में parents रहते हैं, तो matrimonial dispute को सिर्फ “मेरा divorce case” समझकर ignore करना बाद में बहुत महँगा पड़ सकता है.
Property papers, ownership documents, residence history, family arrangements और पहले से चले आ रहे court orders को संभालकर रखना जरूरी है.
क्योंकि एक matrimonial dispute कभी-कभी सिर्फ husband-wife relationship तक सीमित नहीं रहता — वह parents, house, possession और family property तक पहुँच सकता है.
यही वजह है कि divorce lawyers in Delhi and Delhi NCR खोजने वाला husband केवल divorce strategy नहीं, बल्कि अपनी family property और parents के legal position को भी समय रहते समझना चाहता है.

यह post Delhi High Court के एक particular property/shared-household dispute पर आधारित है. उस judgment में दिए गए directions उस case के facts, statutory provisions और existing orders के context में थे; इसका मतलब यह नहीं है कि हर matrimonial dispute में daughter-in-law को property से हटाया जा सकता है या हर elderly parent को automatically समान relief मिलेगा.
